Welcome to ChainSpark. These terms and conditions outline the rules and regulations for the use of the ChainSpark platform.

By accessing this platform, we assume you accept these terms and conditions in full. Do not continue to use ChainSpark if you do not accept all of the terms and conditions stated on this page.

2. Platform Description

ChainSpark is a decentralized platform for AI agent creation, customization, and deployment. The platform utilizes blockchain technology for tokenization of AI agents and operates a DAO (Decentralized Autonomous Organization) for governance.

Our platform allows users to create, customize, and interact with AI agents, participate in governance through the DAO, and engage in various activities related to the ChainSpark ecosystem.

3. User Accounts

To access certain features of the platform, you may be required to create an account and connect a blockchain wallet. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this provision.

4. Intellectual Property

The ChainSpark platform, including but not limited to its code, design, functionality, and branding, is owned by ChainSpark or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Content generated by AI agents on our platform is subject to the following ownership rules:

  • Content generated by users through our AI agents belongs to the user who initiated the generation, subject to our license to use such content as described below.
  • Users grant ChainSpark a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute content generated through our platform for the purposes of operating, promoting, and improving our services.
  • ChainSpark does not claim ownership of user-provided prompts or inputs.

5. Tokenomics and Blockchain Interactions

The ChainSpark platform utilizes the $SPARK token for various functions within the ecosystem. By using our platform, you acknowledge and agree to the following:

  • Blockchain transactions are irreversible and we cannot recover tokens sent to incorrect addresses.
  • You are responsible for securing your private keys and wallet access.
  • Token values may fluctuate and we make no guarantees regarding the value of $SPARK tokens.
  • Participation in the DAO is governed by smart contracts and on-chain voting mechanisms.
  • Gas fees and other blockchain-related costs are the responsibility of the user.

6. Acceptable Use Policy

When using our platform, you agree not to:

  • Use the platform to generate illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content.
  • Attempt to circumvent any technological measures implemented to protect the platform or its content.
  • Use the platform to infringe upon the intellectual property rights of others.
  • Interfere with or disrupt the platform or servers or networks connected to the platform.
  • Use the platform to distribute malware, viruses, or other malicious code.
  • Engage in any activity that could disable, overburden, or impair the proper functioning of the platform.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ChainSpark and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the platform.

8. Modifications to Terms

We reserve the right to modify these terms at any time. If we make changes to these terms, we will provide notice of such changes by updating the “Last Updated“ date at the bottom of these terms and by providing additional notification if required by applicable law. Your continued use of the platform following the posting of revised terms means that you accept and agree to the changes.

9. Governing Law

These terms shall be governed and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions. Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights.
